Derrick Rose Suspected Set Up Soon After Alleged Rape

Derrick Rose testified Tuesday that he had a hunch his girlfriend was going to claim they raped her the night he and his friends had sex with her.

The NBA star said he became wary of the woman when she texted him later the same day of the purported attack in August 2013. She mentioned on the text message how intoxicated she had been. The woman also referred to burns she asserted she got on her hands from a fire pit outside his Beverly Hills house. Rose said he never saw any burns the night before and he believed that she was sober.

He added that it turned out to be what he thought – a setup.

Rose was testifying for a second day in a lawsuit that claims he and two of his friends had sex with the woman without her consent. The woman said that she was disabled from drinking and, perhaps, drugs.

The woman maintains that the three came into her apartment and had sex with her while she was unconscious. She said she passed out after drinking tequila earlier at the basketball star’s residence.

Rose said that the woman was sober. He also mentioned that he presumed consent based on a text message she sent unexpectedly that morning saying he made her “horny”, her behavior throughout the day and night, and their past.

Rose attested that his mother, who raised him as a single parent, was his mentor and had taught him to respect women.

The woman’s attorneys presented a video of Rose taken in June while he was testifying at his deposition, in which he said he didn’t understand the word consent.

He said he was nervous during the deposition when asked by his own lawyer. He defined consent as both parties being in agreement. The woman had consented to all the previous times they had sex over an 18 – 20 month period, he said.

Rose said he assumed her suggestive text the morning of August 26 as proposing consent even if they had broken up two months earlier.

Sloppy lawyers

The trial is proceeding although US District Court Judge Michael W. Fitzgerald considers declaring a mistrial after slamming the accuser’s lawyers as “unbelievably careless” in production of exhibits.

Lawyers of the NBA star asked Fitzgerald to declare a mistrial. This is because they had not been provided three text messages that are important to their case until Rose went on the witness stand on Friday.

Fitzgerald stated the seriousness of the matter and asked the lawyers to confirm the disclosure of the texts.

The woman sent the said texts to Rose. The defense lawyers said they noticed text messages that hadn’t been disclosed before the trial when they happened to look at exhibits given to them in a binder on Friday.

The judge did not specify when he would decide on the mistrial appeal.
